What personal information do we collect, and how is it used?
In the process of carrying out works for a client we collect the following data:
We collect a client's name for the purposes of tracking their project, for file and folder organization and for managing the sending of files from the PC to our laser engravers.
In order to contact the customer regarding their project we collect at least one form of contact information from the following list:

When customers place their order remotely we may supply a pro-forma invoice. When the goods are to be shipped by us to the customer we will collect an address for invoicing and an address for delivery, in order to calculate shipping costs, take the payment and ship the goods.
We may collect a customer's paypal email address for the purposes of sending paypal money requests.
Artwork supplied by the client or created by us on the client's behalf may include identifying information, including but not limited to:
- wedding invites that include names, venue and date information.
- business cards that include names, addresses, job roles and contact information.
- images or photos of the customer, family, acquaintances or property.
While we do not intentionally collect protected category information, client projects may involve personal information that falls under protected categories. Examples may include:
Clients may provide information to us that relates to people other than themselves, for example when a client is having a gift made for a friend or partner. Only information that is provided to us by the client that is needed to complete the project will be stored.
What is our legal basis for collecting personal information?
We collect personal information under the following legal bases laid out in article 6 of the GDPR:
(a) Consent: the individual has given clear consent for you to process their personal data for a specific purpose.

Information may be stored on selected third party cloud-based services which are used in the running of our business. Only services that provide a high level of security are used.

What personal information do we collect, and how is it used?

In order to contact the customer regarding their project we collect at least one form of contact information from the following list:
- mobile telephone number
- landline telephone number, including switchboard extension numbers where applicable
- e-mail address
- facebook username where the customer contacts us first through our facebook page
- contact number or username for messaging apps including whatsapp, Instagram and facebook messenger
We collect this information for purposes including:
- making appointments for customers to deliver materials, or discuss their projects
- sending the customers images of artwork or files for approval
- arranging for clients to collect their goods
- contacting the customer where trade credit is extended if payment is overdue

Clients may provide information to us that relates to people other than themselves, for example when a client is having a gift made for a friend or partner. Only information that is provided to us by the client that is needed to complete the project will be stored.

- personal information relating to financial and accounting obligations is stored for as long as necessary under UK regulations
- digital files created in the course of completing a customer's project may be stored for as long as we deem it likely to be needed:
- where a customer has paid Hey Create to create digital files, we will store a copy for at least 3 months in case the customer requires copies, unless you ask us to delete it sooner
- digital files and personal information for repeat customers will be stored for as long as the customer is likely to retain the services of Hey Create
- digital files created for a customer that the customer has not been charged for may be deleted at any point Hey Create deems it necessary
Who do we share your information with?
Hey Create will share personal information with selected third parties under the following bases:
- third parties involved in the delivery chain, for example delivery companies or third-party suppliers of materials necessary for the customer's project
- our legal advisors where necessary to receive correct legal advice
- where you order is due for delivery outside the UK, we may need to share information with customs authorities both in the UK and in the country of destination. We may also share personal information with law enforcement or other governmental authority, e.g. to report a fraud or in response to a lawful request
- our accountants where required to comply with financial and accounting regulations
- public forums including Hey Create's Instagram account, Facebook page, etc, only where explicit written consent has been supplied by the customer. Information shared may include customer personal and business names, images of work that contain personal information, contact details or any other information the customer has allowed the use of.
- where Hey Create is purchased or otherwise taken over by a third party, the list of personal information about customers will be one of the transferred assets

We will only use our own images or images provided by you with your express written permission. Definitions
Client - The person or persons listed on the quotation / purchase order
Seller - Hey Create of 10 Luther Road, Bournemouth, BH9 1LH
The Goods - all items and services provided by Hey Create as listed in the purchase order
The Job - the entirety of the materials, processes and other work involved in the production of the goods by Hey Create
Purchase Order - the list of items and services to be provided by Hey Create according to the terms and conditions listed here
Status
By placing an order with Hey Create you confirm that you are a) over 18 years of age and b) legally able to enter into a binding contract.
Supply of Goods
Hey Create shall provide the client with goods in accordance with Hey Create's written quotation or invoice, or with a Purchase Order provided by the client provided it is accepted by Hey Create in writing.
Pricing
Hey Create will provide the Client with a written quotation or purchase order for the goods. This price will be calculated to the best of our abilities based on the Client's specifications and any materials or information supplied by the Client. The quotation will be applicable to the specification as agreed. Hey Create reserves the right, by giving written notice at any point prior to delivery of the goods, to charge the Client any extra costs incurred by the inaccuracy of Client-supplied information, or by factors outside Hey Create's control which incur extra costs during the Job.
Any changes to the Job specification once the Job has commenced may be subject to additional costs or cancellation. No order may be cancelled without the written agreement of Hey Create, and on terms that the Client shall reimburse Hey Create for any costs and damages incurred by cancellation.
Manufacture
We warrant only that the goods shall be provided by us in accordance with the Client's specifications as provided to us and to normal working practices and standards. Any advice given by Hey Create on the suitability of a material or process for a Job is strictly limited to its suitability for our working practices, but we will give this advice to the best of our abilities. We do not guarantee that the goods will be fit for any particular purpose.
Hey Create shall not be liable for any defects arising from Client-provided specifications or materials. Hey Create shall not be liable for any defects arising from materials used for the goods. Hey Create shall pass on to the Client any warranty or guarantee provided by the materials manufacturer where applicable.
Where a Client is supplying goods and materials Hey Create shall make the Client aware of potential risks involved. Should the Client instruct Hey Create to proceed with the works after being made aware of the risks and the results are not to the Client’s expectations, this will not constitute a mistake on the part of Hey Create and Hey Create shall bear no liability for damages incurred by the Client.
Where the Client is supplying high-value goods or materials for works, the Client must make Hey Create aware of the values for quoting purposes. Where a Client does not make Hey Create aware of the values prior to quoting and instruction to proceed, Hey Create shall bear no liability for defects or damages arising from the works and the maximum value of any compensation offered by Hey Create shall be for the amount quoted for the works.
Payment
Payment shall be made in full on completion of the job and before delivery to the Client, unless expressly stated in writing by Hey Create.
Where invoices are issued on a credit basis, invoices shall be paid in full no later than 30 days from date of issue only where explicitly stated. Hey Create reserves the right to charge interest of 8% above Bank of England base rate on late payments. Hey Create reserves the right to withdraw credit facilities at any time, whereupon goods and services shall be provided on a pro-forma basis until further notice.
Hey Create may choose to require a deposit or stage payments on large orders. Deposits shall be non-refundable unless expressly stated otherwise.
Delivery
Goods shall a) be collected from Hey Creates's premises by the Client or b) delivered to a place of the Client's choosing using a postal or courier service agreed upon by Hey Create. Costs for delivery other than at Hey Create's premises shall be at the Client's expense. Quotations shall not include costs for handling and postage unless expressly requested by the Client. Hey Create will estimate postage costs where possible but these estimates shall not be binding unless agreed in writing by Hey Create.
It is the clients responsibility to arrange collection of goods. The client has 14 days in which to collect an/any item/s goods and after which Hey Create has the right to charge a storage fee. If item/s are not collected within 30 days and no prior written arrangements are made, then Hey Create will be free to dispose of item/s, goods.
Risk and Title
Risk shall pass to the Client at the point of delivery. For goods that will be delivered at Hey Create's premises this shall be from the point Hey Create informs the Client the goods are ready for collection. For goods that shall be delivered to another address risk shall pass to the Client at the point the goods pass to the delivery service.
Title in the goods shall not pass to the Client until payment has been received in full by Hey Create.
Liabilities
Hey Create warrants that the goods as delivered shall be free from defects in workmanship, shall be produced with skill and correspond to their specification as agreed. Hey Create shall bear no liability for any losses or damages incurred by the Client or any third party in connection with the goods.
Where a third party is involved in supply of the goods Hey Create shall bear no liability for defects, losses or damages that arise from the third party's provisions and services.
Hey Create shall not be liable for any consequential losses that arise from failure to provide goods by a given date, or from goods not being up to standard or failing.
Intellectual Property
Where a Job involves client-supplied materials or potentially copyrighted or trademarked materials, the Client shall provide written confirmation of their right to use those materials to produce the goods. The Client shall indemnify Hey Create against any loss, damages, expenses or other claims that may arise from infringing materials.
Any materials provided by the Client shall remain their intellectual property, and will be kept strictly confidential by Hey Create except for uses agreed on with express written consent form the Client.
Any materials created by Hey Create in order to produce the goods shall remain the property of Hey Create unless expressly agreed in writing.
Force Majeure
Hey Create shall not be held liable for any failure to provide goods for reasons outside of Hey Create's control. This may include, but is not limited to, fire, flood, government legislation, war, terrorist actions or lack of delivery from suppliers. During these periods Hey Create shall be released from contractual obligations until such time as Hey Create is able to resume normal business.
General
English law shall apply to the Contract, and both Hey Create and the Client agree to submit to the jurisdiction of an English court. If any part of these terms and conditions are found to be invalid or unenforceable this shall not affect the remainder of the terms and conditions.
